The PICT Childhood Abuse Training
Terms & Conditions Policy - July 2010
1. DEFINITIONS
In this document the following words shall have the following meaning.

1.1 'PPT’ means Penny Parks Training Ltd. (and its subsidiaries) the organisation accrediting and administering the provision of PICT Childhood Abuse Training, through its authorised third party trainers, under the umbrella of the Penny Parks Foundation.

1.2 ‘PPF’ means the Penny Parks Foundation a PPT subsidiary.

1.3 ‘PICT’ means Parks Inner Child Therapy’, the therapy model created and developed by and copyright of Penny Parks.

1.4 ‘Student’ means the organisation or person who purchases goods and services from PPT.

1.5 ‘Penny Parks’ means Penny Parks or her beneficiaries.

1.6 ‘PICT Practitioner’ means a practicing therapist/counsellor who has successfully achieved a PICT qualification/certification.

2. PRICE AND PAYMENT for PICT CHILDHOOD ABUSE TRAINING

2.1 Payment for the PICT Childhood Abuse Training can be made in two ways:

a. The full amount (£1800) paid by cheque or bank transfer one month prior to course commencement.

b. Interest free instalments paid over a period of time, comprising three cheques (or Standing Order payments) of £600.00 each, paid monthly. Full payment must be received one month prior to course commencement.

2.2 If full payment is being provided by an employer, it is the student’s responsibility to ensure the funding body is fully aware of payment procedures and deadlines and that Penny Parks Training is notified that a funding body is involved.

2.3 Where students are wishing to split payment with their employer, it is the students responsibility to ensure full course costs are paid up front by the deadline to Penny Parks Training and to make separate reimbursement arrangements with their employer.

2.4 Should a purchase order be required for payment of the invoice, it is the student’s responsibility to ensure PPT has the full details and agreed purchase order before the products or services are supplied.

2.5 Students who do not honour their Standing Order or the payment deadlines will incur a late charge of £50.00 for each payment missed. PICT Certification will not be issued until all outstanding monies owed to Penny Parks Training, or extra tuition fees owed to the Trainer, have been paid.

2.6 Once Module One notes have been issued (3 weeks prior to course start) there will be no refunds given. By signing these Terms & Conditions, students who are accepted on the course are committed to pay the full course fee regardless of any subsequent cancellation by student or their withdrawal from course by trainer.

2.7 A refund for modules not yet taken will be given if a student leaves the training due to evidenced exceptional circumstances (deemed exceptional by PPT) that also prohibits the student from transferring to an alternate PICT training. An administration fee of £50 will be due, no refunds will be paid for modules already attended - module course notes already received will be considered as a module attended.

2.8 In the event of the course having to be cancelled by the trainer before it commences, an alternative date and venue (and perhaps trainer) will be offered, although students may choose to receive a full refund of monies paid. The trainer and Penny Parks Training Ltd. accept no liability for any consequential or indirect loss.

2.9 Students who have successfully completed the training will receive an invoice for the certification fee (£35.00). On receipt of this amount PICT certification will be posted to the student.

2.10Qualified PICT Practitioners who wish to be listed on the PPF website agree to pay a £25.00 administration fee per year and take full responsibility for notifying PPT of any changes to their details.

3. DELIVERY AND PROGRAMME INFORMATION

3.1 PICT is an experiential course, with no role-play utilised, students are required to use their own personal experiences during experiential exercises as they learn all techniques. Students not appropriately engaging in these exercises may be withdrawn from the training.

3.2 Module notes are sent three weeks prior to each module. It is mandatory that students read notes completely to familiarise themselves with the material, write any queries in their reflective journal and present those queries when the module commences. Students are instructed NOT to utilise any PICT technique contained in the module notes prior to receiving proper training.

3.3 To achieve a PICT Practitioner qualification, students agree to be assessed against the following personal qualities: flexibility, adaptability, self awareness, willingness to embrace change, self respect and integrity, as well as, question sheet results and the quality of pairs work.

3.4 PICT is based on varied and flexible scripted work, if potential students are unable to, or are averse to, reading scripts aloud in a relaxed, conversational manner they will not be successful in achieving a PICT qualification.

3.5 Students must disclose any information, including, but not exclusive of, any medical, emotional, or physical condition or learning challenge, (e.g. diabetes, epilepsy, bi-polar, aspergers, dyslexia, hearing or sight problems) that could adversely impact on their own or others learning experience. Failure to do so may result in being withdrawn from the training.

3.6 Individual students must agree to being ‘tasked’ (given specific undertakings during the course) should the trainer feel it would be of positive benefit in their development towards becoming a PICT therapist.

3.7 If a student has not disclosed they have unresolved or overwhelming personal material and it consequently impacts adversely on their own and others learning experience, they will be withdrawn from the training and referred to a PICT Practitioner (at additional cost to the student). When successful therapy is complete they can resume their PICT training on the next available course.

3.8 Students will be required to keep an ongoing reflective journal.

3.9 Students found to have misrepresented themselves regarding their application form, personal interview, professional training qualifications, professional indemnity insurance policy or professional body membership will immediately be withdrawn from the PICT course and be unable to apply for any future PICT training.

3.10Students are expected to attend the full 18 training days to receive PICT Practitioner Certification. Up to two days may be missed through illness or unforeseen circumstances, but must be made up by booking private tuition with the trainer, at extra cost (£125.00 per day paid directly to the trainer).

3.11Leaving early on the last day of any module will be considered a day missed (requiring private tuition). Therefore students are required to arrange their travel plans, and social engagements to fully accommodate the course hours – there will be no exceptions.

3.12Any final decisions regarding a student’s standing on any course will be made by Penny Parks Training Ltd. after consultation with any third parties relevant to that decision. An appeal to that decision can be made to the accrediting body, the National Council of Psychotherapists.

3.13PPT shall not be liable for any loss, costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery of the training.

3.14PPT are not liable for any additional travel and accommodation costs the delegate may incur should the training dates or venue be altered.

3.15In the event of a trainer becoming incapacitated in any way and unable to complete the training, another PICT trainer will be complete the training.

4. PICT TRAINING COST VARIATIONS & FORMATS

4.1 When a PICT Trainer teaches a course outside of her local area, for varied students, the fee is increased to £2250.00 to cover venue, travel, food and accommodation. Class size required is 10 minimum – 12 maximum.

4.2 When a specific group requests a Trainer to teach at the group’s location, class size is 6 minimum – 12 maximum, and the course fees will remain at £1800.00, but the group will supply and meet the costs of:
• trainer accommodation, subsistence (£20 per day) and travelling expenses.(40p per mile)
• venue (room/s large enough to accommodate the students working in pairs)
• flip chart/pens
• break refreshments

4.3 PICT Childhood Abuse Training is offered in two formats. Format One is the standard training held in the UK. Format Two is designed for courses held abroad, but if required and suitable is also available in the UK.

Format One - Nine, 2-day, monthly modules (approximately nine months overall). Week days or weekends.

Format Two - Three, 6-day, segments, each held two months apart (approximately seven months overall).

5. INTELLECTUAL PROPERTY RIGHTS

5.1 Unauthorised use of the PPT or PPF logos or of the phrase ‘PICT’ or ‘Parks Inner Child Therapy’ is not permitted at any time.

5.2 No student may claim to be a PICT Practitioner or to carry out unauthorised practice of Parks Inner Child Therapy until they have received their PICT qualification certificate.

5.3 All Intellectual Property Rights produced from or arising as a result of PICT training shall, so far as not already vested, become the absolute property of Penny Parks, and the student, or consequent PICT Practitioner, shall do all that is reasonably necessary to ensure that such rights vest in Penny Parks by the execution of appropriate instruments or the making of agreements with third parties.

6. WAIVER
The failure by either party to enforce at any time or for any period any one or more of the Terms and Conditions herein shall not be a waiver of them or of the right at anytime subsequently to enforce all Terms and Conditions of this agreement.
7. GOVERNING LAW AND JURISDICTION
This agreement shall be governed by and construed in accordance with the English law and the parties hereby submit to the exclusive jurisdiction of the English courts.
8. ENTIRE AGREEMENT
This agreement contains the entire agreement between the parties relating to the subject matter and supersedes any previous agreements, arrangements, undertakings or proposals, oral or written. Unless expressly provided elsewhere in this agreement. This agreement may be varied only by a document signed by both parties.
